The Uttarakhand High Court today delivered a judgment clarifying that the end of a relationship formed on the dating app Tinder cannot be used as a basis for filing a rape complaint. The court held that rape is a criminal offence that requires an act of sexual assault, not merely a breakup or a change in personal feelings.
In its decision, the judges emphasised that the legal system must not be misused to pursue frivolous or retaliatory charges. They pointed out that the law protects individuals from actual sexual violence, and a breakup does not meet that threshold.
