The Kerala High Court declined a petition to cancel a rape case, ruling that a Muslim marriage does not provide immunity under the POCSO Act.

The Kerala High Court turned down an application seeking to set aside a rape case that had been filed under the Protection of Children from Sexual Offences (POCSO) Act. The petition argued that the alleged victim was married under Muslim personal law, and therefore the case should be dismissed.

The bench observed that the POCSO Act is a special legislation aimed at safeguarding minors, and its provisions apply irrespective of the victim's religion or marital status. A marriage, even if solemnised under personal law, does not create a legal shield against the stringent provisions of the child‑protection law.

By refusing to cancel the case, the court reinforced the principle that child sexual offences are to be dealt with uniformly across all communities, ensuring that no religious or personal law can override the statutory safeguards provided by POCSO.
