Chhattisgarh High Court Restores Wife's Plea in Ex-Parte Divorce Case

The Chhattisgarh High Court has restored a wife's plea to contest a divorce decree passed without her appearance. The court set aside the ex-parte order and allowed her to present her case.

A family court had earlier granted a divorce ex parte after the wife did not appear before it. The wife contended that she was not properly notified or had valid reasons for her absence, and approached the High Court seeking restoration of her plea.

The High Court heard her arguments and found merit in her request to set aside the ex-parte order. It observed that justice required giving her an opportunity to be heard before finalising the divorce.

Accordingly, the court restored her plea and directed the lower court to proceed afresh, ensuring that the wife gets a fair chance to present her side in the matrimonial proceedings.
