The West Bengal Authority for Advance Ruling has clarified that recovering electricity charges at actual cost does not attract Goods and Services Tax.

The West Bengal Authority for Advance Ruling (AAR) has issued an opinion stating that electricity recovery based on actual cost is not liable to Goods and Services Tax (GST). The ruling clarifies that such recovery is treated as a cost reimbursement rather than a supply of service, and therefore falls outside the GST ambit.

Under the prevailing GST framework, most electricity sales are taxable. However, the AAR’s interpretation distinguishes between a commercial sale and a reimbursement of expenses incurred by the distribution companies, exempting the latter from tax.

The decision is expected to guide state electricity distributors in revising their billing structures. Companies can now adjust invoices to reflect the GST exemption, potentially lowering the amount payable by consumers for cost‑recovery components.

State officials indicated that the ruling will be communicated to all relevant utilities to ensure uniform implementation across West Bengal.
