The Supreme Court held that a divorce granted abroad cannot be enforced in India unless it meets specific legal criteria.
The apex court delivered a judgment clarifying that foreign divorce decrees are not automatically enforceable in India. The bench stressed that recognition requires compliance with Indian law, including proper service and jurisdiction.
The decision arose from petitions filed by Indian citizens challenging the validity of overseas divorces. The court observed that, in the absence of a reciprocal treaty or explicit statutory provision, Indian courts cannot give effect to such foreign orders.
Legal analysts note that the ruling will affect many Indians married abroad who have obtained a divorce overseas. They may now have to approach Indian courts for a divorce or secure a fresh decree that satisfies domestic legal requirements.
The judges also directed lower courts to assess each case on its merits, ensuring that parties are not disadvantaged by procedural gaps in foreign proceedings.
