The Supreme Court has asked the Bihar government to explain why a minister has remained in office for more than six months without a legislative election, citing Article 164(4) of the Constitution.
The Supreme Court of India on Thursday asked the Bihar government to explain why a minister has continued to serve for more than six months without a fresh election, after a change in the state administration.
Under Article 164(4) of the Constitution, a minister who is appointed after a change in government can remain in office only for a maximum of six months until the next legislative election.
A petition filed in the court challenges the re‑appointment of the minister following the formation of the new government, arguing that the tenure exceeds the constitutional limit.
The court also referred to a prior judgment on similar provisions, underscoring the importance of adhering to the constitutional time frame for ministerial appointments.
