The Supreme Court has directed authorities to establish standard operating procedures to prevent digital arrests and to ensure refunds are processed within a specified time frame.
The Supreme Court, in a recent judgment, mandated the creation of standard operating procedures (SOPs) aimed at curbing the practice of digital arrests. The order directs the Ministry of Home Affairs and related agencies to develop clear guidelines for the use of digital platforms in the arrest process.
The Court emphasized that any arrest carried out through digital means must follow a transparent and accountable procedure, with checks to prevent misuse. It also called for the establishment of monitoring mechanisms to ensure compliance across all jurisdictions.
In addition to curbing digital arrests, the judgment requires authorities to facilitate refunds within a time-bound framework. The Court specified that any funds held or withheld in connection with digital arrest cases must be returned to the affected individuals within a stipulated period, thereby safeguarding citizens’ financial rights.
