The Sikkim High Court has ruled that a POCSO case cannot be dismissed through settlement even if the survivor reaches the age of majority.

The Sikkim High Court today held that a case under the Protection of Children from Sexual Offences (POCSO) Act cannot be quashed on the basis of a settlement even when the survivor attains the age of majority. The court emphasized that the settlement does not absolve the accused of liability or close the legal process. It clarified that the case remains active until the trial is completed, ensuring that the survivor’s rights are protected. This ruling reaffirms the judiciary’s stance that child sexual abuse cases must be pursued to the fullest extent of the law.
