The Rajasthan High Court has stayed the termination of a government employee who was found to have hidden a conviction that had previously been stayed.

The Rajasthan High Court issued an order on Wednesday staying the dismissal of a government servant who had concealed a criminal conviction. The employee, who works for a state department, was slated for termination after the administration discovered that the conviction, although stayed by a lower court, had not been disclosed in the service records.

According to the court documents, the employee failed to mention the pending conviction in the mandatory declaration forms required for recruitment and promotion. While the conviction was stayed, the law mandates that any pending case must be reported, and the omission was deemed a violation of service rules.

The bench held that the procedural lapse in the termination process required rectification and therefore ordered the suspension of the dismissal until a detailed inquiry is completed. The court also directed the department to ensure that due process is followed before any final action is taken.

Legal experts note that the ruling underscores the importance of transparency in service applications and may set a precedent for how similar cases are handled across the state bureaucracy.
