A Rajasthan court has ruled that unrebutted communication from a competent authority takes precedence over information obtained through the Right to Information Act.

The Rajasthan High Court, in a recent judgment, clarified that when a competent authority issues communication that is not contested, it holds higher evidentiary weight than information supplied via the Right to Information Act. The decision follows a petition filed by a citizen who sought to challenge the validity of an RTI response. The court held that the authority’s unchallenged statement is more reliable and should be accepted as prima facie evidence. This ruling is expected to influence future RTI disputes across the state.
