The Madhya Pradesh High Court has set aside a court order demanding a widow pay back Rs 1 lakh, ruling that there was no fraud in the alleged excess salary case.

The Madhya Pradesh High Court in Jabalpur quashed a lower court's order that sought to recover Rs 1 lakh from a widow, alleging that she had received excess salary. The bench examined the evidence and concluded that there was no fraudulent intent or wrongdoing on the part of the widow. Consequently, the recovery petition was dismissed and the amount was not to be reclaimed.

The decision underscores the court's scrutiny of financial recovery claims, especially where vulnerable individuals are involved. Legal experts note that the ruling may set a precedent for similar cases where the basis of alleged overpayment is contested.
