The Kerala High Court has set aside a criminal case against a teacher under the Juvenile Justice Act, ruling that minor corrective actions do not constitute a criminal offence.

The Kerala High Court has quashed a pending criminal case filed under the Juvenile Justice (Care and Protection of Children) Act against a school teacher. The bench observed that the allegations pertained only to trivial corrective measures taken in a classroom setting and did not rise to the level of a criminal offence.

In its judgment, the court emphasized that the Juvenile Justice Act is intended to address serious violations affecting the welfare of children, not routine disciplinary actions that are proportionate and non‑violent. Consequently, the petition seeking dismissal of the case was granted.

Legal experts noted that the decision reinforces the principle that criminal provisions cannot be invoked for minor, pedagogical corrections, thereby providing clarity for educators across the state.

The ruling is expected to influence how lower courts assess similar complaints involving teachers and the application of child protection statutes.

The bench also directed the lower court to close the file and expunge any pending charges, underscoring the need for a balanced approach between child safety and reasonable school discipline.
