The Gauhati High Court has overturned the preventive detention of social activist Pranab Doley under the National Security Act, citing legal and factual deficiencies in the order.
Gauhati High Court on Wednesday nullified the preventive detention of social activist Pranab Doley, who had been held under the National Security Act (NSA). The bench held that the detention order could not be sustained on either legal or factual grounds.
The court observed that the authorities failed to disclose essential information about Doley's pending criminal cases and did not provide material particulars to substantiate the allegations that justified his confinement.
Furthermore, the judgment noted that Doley's legal representation was not given a fair opportunity to contest the detention before the order was passed. As a result, the court ordered his immediate release and directed the state to review its procedures for invoking the NSA in future cases.
