Chief Justice of India Surya Kant emphasized that the Constitution must serve as the guiding framework for the judiciary in cases where existing statutes provide no clear direction.

Chief Justice of India Surya Kant recently asserted that the Constitution ought to be the primary reference for courts whenever statutory law is silent or ambiguous. He highlighted that the Constitution’s fundamental rights and overarching principles fill legislative gaps, ensuring that justice is not denied due to the absence of specific statutes.

The CJI urged judges at all levels to turn to constitutional provisions and established jurisprudence when confronting novel or complex issues. By doing so, the judiciary can uphold the rule of law while respecting the democratic framework enshrined in the nation’s supreme document.

Legal analysts note that such guidance is increasingly vital as courts grapple with emerging challenges in technology, environment and public health, where legislation often lags behind societal change. Surya Kant’s remarks reinforce the judiciary’s duty to interpret the Constitution as a living instrument, safeguarding rights and liberties across India.
