An illegal arrest that drew public attention prompted senior advocate Javed Pashu Sayyed to clarify the legal safeguards that the Constitution guarantees to every citizen. Sayyed emphasized that any detention must be based on a valid warrant or clear statutory authority, and that the arrested person has an immediate right to be informed of the grounds for arrest.
He reminded that the Constitution enshrines the right to legal counsel, the right to be produced before a magistrate within 24 hours, and protection against arbitrary deprivation of liberty. These provisions, he said, are designed to prevent misuse of police powers and to ensure that due process is observed.
Sayyed also referred to the BNSS framework, which he described as a set of procedural checks that monitor police conduct and provide avenues for redress. Under BNSS, complaints of unlawful detention are to be investigated promptly, and any violation can trigger disciplinary action against the officials involved.
