The Chhattisgarh High Court held that a fatwa has no legal authority to impose a social boycott on individuals.

The Chhattisgarh High Court ruled that a religious edict, or fatwa, cannot be used as a legal tool to socially ostracise any person. The bench clarified that while fatwas may carry moral weight within a community, they do not possess statutory force under Indian law.

The court emphasized that imposing a social boycott infringes on fundamental rights guaranteed by the Constitution, including the right to equality and freedom of association. Any attempt to enforce such a boycott would therefore be deemed illegal and subject to judicial scrutiny.

The judgment was delivered in response to a petition challenging a fatwa that sought to isolate an individual from community activities. By dismissing the claim, the High Court reinforced the principle that religious pronouncements cannot override civil liberties.

Legal experts noted that the ruling sets a precedent for similar cases across the country, ensuring that religious directives cannot be weaponised to curtail personal freedoms.
