Tripura High Court Rejects Petition to Dismiss Cases Over Abusive Posts Against PM

The bench of the Tripura High Court dismissed a petition seeking the withdrawal of criminal cases registered against individuals accused of posting abusive content about the Prime Minister on social media. The court held that the allegations of harassment and insult fall within the ambit of existing statutes that criminalise hate speech and online defamation.

Judicial observers noted that the decision reinforces provisions of the Information Technology Act and the Indian Penal Code, which deem the circulation of offensive or threatening material against a public figure a punishable offence. The court emphasized that freedom of expression does not shield content that incites hatred or threatens the dignity of the nation’s leader.

Legal experts said the ruling sends a clear signal that courts are unlikely to entertain attempts to shield perpetrators of digital abuse merely on the grounds of free speech. The bench also warned that any future attempts to dilute the applicability of these laws could be met with stringent judicial scrutiny.
