The Rajasthan High Court ruled that the 12‑month limitation period for recovering interim maintenance will start from the date the order is passed, dismissing the husband’s petition.

The bench headed by Justice Farazand Ali clarified a procedural point in maintenance cases, stating that the 12‑month limitation period for recovering interim alimony will be calculated from the date the court order is issued, not from the date of the alleged default. This interpretation removes any benefit of retroactive counting and aligns the limitation period with the actual enforceability of the order.

The decision came in response to a petition filed by a husband seeking to challenge the timing of the limitation period. The High Court found no merit in the petition and dismissed it outright, reinforcing the principle that the clock starts ticking only after the order becomes effective.

Legal experts note that the ruling provides clearer guidance for both petitioners and respondents in maintenance disputes, reducing ambiguity in future cases across Rajasthan. The judgment is expected to be cited in lower courts handling similar matters.

The order underscores the High Court's role in ensuring timely enforcement of family law provisions while safeguarding the rights of maintenance recipients.
