The Gwalior bench of the Madhya Pradesh High Court has declared the 10 August 2026 notification establishing the State Transport Authority valid and dismissed a petition filed by private bus operators challenging it.
The Gwalior bench of the Madhya Pradesh High Court delivered its judgment on a petition filed by a group of private bus operators contesting the state's decision to create a State Transport Authority.
The petitioners argued that the notification dated 10 August 2026, which formally established the authority, exceeded the state's legislative powers and would adversely affect their commercial operations.
After reviewing the legal provisions and the scope of the state's competence, the bench concluded that the notification was within the permissible limits of state legislation. Consequently, the court declared the notification valid and dismissed the petition in its entirety.
The ruling clears the path for the newly formed State Transport Authority to assume its regulatory duties over road transport across Madhya Pradesh without further judicial impediment.
